Our firm regularly represents individuals and hedge funds engaged in publishing and speaking about their analyses of companies and individuals engaged in accounting manipulations, insider trading, and fraud. Some of the companies and executives believe the best defense is a good offense, and accuse our clients of defamation. We handle those cases in the United States and work with counsel in foreign countries when cases are brought there.
We also field inquiries from the Securities and Exchange Commission and regulators in foreign countries (typically through the SEC, but sometimes directly), and from lawyers engaged in civil litigation, who seek out information from our clients. These inquiries require us to balance government regulators’ desire for information against our clients’ interests in protecting confidential sources.
